Meta's New AI Ad Terms Start October 30: Who Owns Your AI-Made Ads?

What changes on October 30

Meta shows a notice on its terms pages: it is updating the Self-Serve Ad Terms, the terms you accept to buy ads in Ads Manager, so that they include the Ad Creative Generative AI Terms. The update goes into effect on October 30, 2026.

The AI terms cover Meta's generative AI features inside Ads Manager and the Marketing API, the tools that generate backgrounds, images and text variations for your ads. After October 30, those rules sit inside the same agreement you already accept to run ads at all.

The rules below come from the current Ad Creative Generative AI Terms page, read on 8 October 2026. Meta's notice links to the updated version; read it once before the 30th.

Who owns what

ItemWhat Meta's AI terms say
Photos, logos and text you give the AI (the "input")You keep the rights you already had
Images and text the AI generates (the "output")Meta keeps the rights it has
Using the output in ads on Facebook and InstagramAllowed: Meta grants you the right to use it on Meta's products
Using the output anywhere else"Unauthorized and a violation of these Terms"
Your inputYou give Meta a perpetual, worldwide, non-exclusive, royalty-free license to use it
UniquenessThe output "may not be unique across users"
Key point

The line that matters most for a small advertiser is the one about outside use. An image made by Meta's generator is meant to stay in Meta's ads. Your website, your emails, your Google or TikTok ads are outside that permission.

Three more rules worth knowing

  • Do not pass AI output off as human-made. The terms say you must not misrepresent output as human-generated when it is not.
  • Do not strip watermarks. You must not alter or remove any watermark or content-authenticating metadata that comes with the output.
  • Do not use the output to build a competing AI model. This one is aimed at AI companies, not store owners.

Does this change anything for your ads?

It depends on where your ads come from.

  1. You only use Meta's built-in AI and only run on Facebook and Instagram. You are covered. Just know that Meta, not you, holds the rights in the generated images, and that another advertiser can end up with a similar image.
  2. You make ads in another tool and upload them. These terms cover Meta's own AI tools. Ads made elsewhere follow the terms of the tool you made them in.
  3. You reuse the same image on your site, in emails or on other ad platforms. A Meta-generated image is not cleared for that. Keep a separate source for anything you need outside Meta.

What to do before October 30

  • Open the Ad Creative Generative AI Terms and read the "Rights in Ads Content" section. It is short.
  • Check which Advantage+ creative enhancements are switched on in your ad account, and turn off any you do not want.
  • Decide where your ads need to run. If it is only Facebook and Instagram, nothing urgent changes. If you also advertise on Google, Pinterest or TikTok, make those ads with a tool whose terms let you.
  • Keep your logo, product photos and brand colors in one folder you control. Those inputs stay yours.

How IMGPT handles ownership

IMGPT makes static ads outside Ads Manager, so Meta's AI terms do not apply to them. IMGPT's own terms list "Output creatives" as owned by you, subject to a license you give IMGPT to run and improve the service, including model training. Like Meta, IMGPT also says similar creatives may be generated for different users.

How it works: you paste your website URL or describe your business, and IMGPT builds a brand profile with your logo, colors, typography, voice, ideal customer and products. You see and edit that profile for free before you pay. Ads come with 5 headlines and 5 primary texts each, resize to 10+ formats for Meta, Google, LinkedIn, Pinterest and TikTok, and you can publish straight to a connected Meta ad account or download them for other platforms.

Whichever tool you use, read its terms on who owns the output and where you may use it.
